University correspondence



Below I show selected correspondence with the University in the hope that others may learn from my experience.


Aug 31, 2023. An agreement was signed.


Aug 25, 2023. Meeting: Mark Giesbrecht (Dean), Michelle Hollis (acting head, HR), Ed Vrscay (personal advisor).

Before this meeting I anticipated that I would remove my (ongoing, internal) grievance, and that I would not take legal action against the University.

Mark Giesbrecht presented aRetirement Agreement”, joint with the Dean and Provost representing the University. We discussed the document and agreed to work arrangements.

I objected to several aspects of the document, including a statement on medical accommodation, and the requirement that the document be confidential. In particular, the draft agreement restricts my communication to: immediate family members, legal or financial advisors and my personal advisor (Ed Vrscay). Unfortunately I am not allowed to communicate with my medical team, the very people that wrote my original medical documentation. Nor am I allowed to contact academic, professional or other advisors. I expressed these concerns, both in the meeting, and here, on this webpage, for the record. At this point I am uncertain who wrote the document or why they wrote these specific terms. I asked if other Policy 59 agreements were subject to similar confidentiality clauses. I was told by both Michelle Hollis and Mark Giesbrecht that the reason my agreement was confidential was because I was given a “specific deal” that was “outside of the norm” and this should not be shared with others who may ask for similar considerations. Finally I note that during this meeting I was informed that postings on my web page are not at issue.



Aug 16, 2023. Meeting: Mark Giesbrecht (Dean), Karen Parkinson (OH), Michelle Hollis (HR), Ed Vrscay (personal advisor). Notes: 1. Michelle Hollis informed me that there was no way to offer me reduced (teaching) load without a corresponding pay reduction. I was informed that this was due to the benefits policy currently in place at the University. 2. Michelle Hollis and I discussed LTD (long term disability), but I indicated that this was not suitable as I want to continue teaching (just at a reduced load). At this point, the only option remaining to me is according to Policy 59 – reduced load to retirement. I began a negotiation of terms for Policy 59.

Dec 21, 2022. I have been corresponding the the Chair and the Dean on my teaching assignments. Unfortunately it is unlikely I will be able to offer my Audio course in the future. I have in fact offered to take an unpaid leave of absence (W24) to teach the course. My request was denied. I will be appealing this.

Quoting: "Dr. Mann has considerable difficulty managing interactions with others that involve conflict/ confrontation, which exacerbate his existing [redacted]  difficulties.  Most importantly, going forward, he requires a mechanism in place to voice concerns about any factors/developments that negatively impact his functioning at work. He is unable to effectively voice these concerns directly to the Dean (or Department Chair, as the case may be) and as such, would benefit from a point of contact to channel these concerns, perhaps through Occupational Health."

Quoting: "As you may be aware, employment accommodations require the employee to share functional restrictions and limitations or barriers they experience in the workplace. The employer (Supervisor/Manager/Dean) then seeks to explore possible solutions to accommodate the restrictions in a safe and suitable manner. As per the Ontario Human Rights Code, the solution offered will not always be the employee’s “preferred” solution.
Occupational Health cannot specifically dictate how to accommodate Professor Mann, but we can work with you to create a plan that meets Professor’s Mann’s accommodation needs, given the restrictions reported above.  "
